Syncrude Canada is facing two charges after approximately 500 birds died in one of its oilsands tailings ponds last April.
The province is charging the company under the Alberta Environmental Protection and Enhancement Act, which says anyone who stores a hazardous substance has to ensure it doesn’t “come into contact with or contaminate any animals, plants, food or drink.” The maximum fine is $500,000.
Environment Canada is also charging the company under the Migratory Birds Convention Act for putting a harmful substance in an area frequented by birds. The maximum penalty under that charge is $300,000, or six months imprisonment — or both.
Syncrude is scheduled to appear in provincial court in Fort McMurray March 25.
